Commercial contracting
Enterprise, regulated, public-sector, or custom deployments should use a signed order form, MSA, DPA, SOW, security exhibit, and SLA where applicable. Online Terms are the baseline for website access, trials, self-serve accounts, and non-custom use.
1. Acceptance
These Terms govern access to and use of the CVERiskPilot website, hosted application, APIs, documentation, and related services. By using the Services, you agree to these Terms. If you use the Services for an organization, you represent that you have authority to bind that organization.
2. Enterprise Agreements
If CVERiskPilot and Customer sign a separate order form, master services agreement, data processing addendum, statement of work, or other written agreement, that signed agreement controls over these online Terms for the covered Services.
3. Accounts And Access
You are responsible for maintaining accurate account information, protecting credentials, configuring user access appropriately, and promptly notifying CVERiskPilot of suspected unauthorized access. You may not share accounts, bypass access controls, probe systems without authorization, or use the Services in violation of law.
4. Customer Data
Customer owns data submitted to the Services. Customer grants CVERiskPilot a limited right to process Customer Data to provide, secure, support, improve, and operate the Services, and as otherwise described in the applicable agreement and Privacy Policy.
5. AI-Assisted Features
AI-assisted triage, summaries, remediation suggestions, compliance mapping, and query responses are advisory. They may be incomplete or inaccurate and do not replace Customer review, professional judgment, legal advice, security decisions, or compliance submissions.
6. Restricted Data
Do not submit PHI, PCI cardholder data, classified information, export-controlled technical data, CUI, or other data requiring special contractual handling unless CVERiskPilot expressly authorizes that data type in a signed agreement.
7. Acceptable Use
You may not misuse the Services, interfere with platform security or availability, reverse engineer non-public components, submit malicious content, overload systems, scrape except as permitted by documentation, or use the Services to violate third-party rights.
8. Fees
Paid plans, usage fees, billing frequency, taxes, renewals, cancellation, and refunds are governed by the checkout flow, order form, or signed agreement applicable to the Services. Fees are non-refundable unless expressly stated otherwise.
9. Availability And Changes
CVERiskPilot may update, suspend, or discontinue features to improve security, reliability, performance, or product quality. Any uptime, support, or service-credit commitment applies only if expressly stated in a signed order form, SOW, or SLA.
10. Disclaimers
Except as expressly stated in a signed agreement, the Services are provided as is and as available. CVERiskPilot disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
11. Liability
To the maximum extent permitted by law, CVERiskPilot will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenues, goodwill, or data. Any liability cap in a signed agreement controls for enterprise customers.
12. Governing Law
These Terms are governed by the laws of Texas, excluding conflict-of-laws rules. Venue for disputes will be in Travis County, Texas unless the parties agree otherwise in a signed agreement.
